I would like to share a definitive 5 Rupees reverse unstruck error coin with me. This coin might well be a post mint damaged coin and not an error coin but post mint damaged coins do not have smooth surface as in this coin although there are numerous scratches and multiple rim damage. Any thoughts :)

Absolutely....unstruck errors sell well over 5000 bucks depending on coin type.

Dear Rony  I think collecting/ accumulation unstruck and error coins/ Notes of Post Independence is illegal according to RBI rules pls check

Nope, there is no such law in the Coinage Act; only mutilation of coins and possessing counterfeit coins are considered illegal.
